Today the United States Supreme Court ruled that the EPA went overboard in its attempt to regulate many small businesses under the guise of the Clean Air Act. With today’s ruling the Court rebuked the EPA’s attempt to misuse the Clean Air Act to regulate small business. The decision left the agency with substantial power to regulate existing sources but made it clear that the EPA’s attempt to re-write the law was an overreach and a violation of the separation of powers.
